Inca Voyage — Terms & Conditions

These Terms & Conditions form the binding agreement (“Contract”) between Inca Voyage, LLC (“the Company”) and the Client (the person(s) named on the booking form or making the reservation). By confirming a booking, the Client agrees to these terms.


1. Booking & Deposits

  • To secure a booking, the Client must pay a 70% deposit of the total trip cost (minimum US $200).
  • Flights (domestic and international) must be 100% prepaid to guarantee seats.
  • Cruise bookings may require different deposit policies depending on the vessel.
  • All deposits are non-refundable.
  • Clients booking via telephone, email, or other channels are deemed to have read and accepted these Terms & Conditions.

Important for Inca Trail Reservations:
If the Client pays by credit card, PayPal, or any method where funds are delayed and Inca Trail permits sell out before payment is received, Inca Voyage will offer one of the following:

  1. A new travel date with permit availability,
  2. Full credit toward any other Inca Voyage service in Peru, or
  3. A refund minus any bank, card, PayPal, or transfer fees and non-refundable expenses already incurred.

A booking becomes definite once Inca Voyage receives the deposit.


2. Payment Policy

  • Final balance is due 45 days before departure (different terms may apply for cruises).
  • Bookings made within 45 days of departure require full payment at time of booking.
  • Accepted payment methods: wire transfer, direct deposit, or check.
  • Clients are responsible for all bank transfer fees.

Currency:

  • Prices are based on USD. Euro and GBP quotes are for reference only.
  • If the Euro/GBP amount paid is more than 4% below the USD price at the payment day’s exchange rate, the amount will be recalculated.
  • Peruvian sales tax (IGV) is not included. Non-residents staying 60 days or less are exempt if proper ID (passport or valid travel document) is shown. After 60 days, IGV applies.

3. Changes by the Client

  • Any changes must be requested by the lead passenger who made the booking.
  • A US$35 amendment fee applies per change, plus any additional supplier charges.
  • Changes are subject to availability and cannot be guaranteed.

Substitution of Travelers

  • Bookings may be transferred to another traveler with at least 30 days’ written notice.
  • An administration fee of US $50 applies plus any supplier costs.

4. Cancellation by the Client

  • All cancellations must be made in writing.
  • Deposits are non-refundable.
  • Flights, cruises, Inca Trail permits, and certain hotel bookings are non-refundable due to supplier rules.
  • If any refund is due, a minimum 12% cancellation fee will apply.
  • Refunds can take up to 45 business days.

Trip Postponement:

  • A 10% administration fee plus non-refundable supplier costs apply.
  • The remaining balance can be used as credit toward future travel with Inca Voyage.

Credit Card Refunds:

  • Subject to processing fees up to 50% plus any non-refundable expenses if refund requested ≥45 days before travel.

5. Changes & Cancellations by Inca Voyage

  • While we strive to operate as advertised, we may modify itineraries due to local conditions.
  • We may substitute services of equal monetary value without compensation if required by safety, logistics, or supplier issues.
  • Major changes: If significant changes occur, Clients may (a) accept, (b) switch to another available trip, or (c) cancel for a full refund (except when caused by force majeure).

Force Majeure includes: war, strikes, riots, civil unrest, terrorism, natural disasters, pandemics, adverse weather, flight schedule changes, government actions, or any event beyond our reasonable control.


6. Surcharges

  • Price increases under 4% (or 2% if booking <6 months in advance) are absorbed by the Company.
  • Increases above these limits will be charged to the Client.

7. Passports, Visas & Vaccinations

  • Clients are solely responsible for valid passports, visas, vaccinations, and preventive medications.
  • Advice provided is in good faith but without liability.

8. Health, Fitness & Participation

  • Clients must ensure they are physically fit for the itinerary.
  • Travelers with medical conditions should consult a doctor before booking.
  • No unaccompanied minors under 18; teenagers may join with a parent/guardian.
  • Inca Voyage may decline bookings or remove travelers whose health, conduct, or noncompliance endangers the group.
  • Travelers unable to swim must inform us if the trip includes water transport so proper safety measures can be arranged.

9. Local Laws

  • Clients must comply with the laws of the countries visited. Failure to do so releases Inca Voyage from all obligations.

10. Illness & Disability

  • Any medical condition must be disclosed at booking.
  • Failure to disclose can result in exclusion without refund.
  • Clients are responsible for carrying required medications and treatment.

11. Complaints

  • Problems must be reported immediately to our local representative/tour leader so they can be addressed.
  • Unresolved issues must be submitted in writing within 28 days of trip completion.

12. Flights

  • Flight prices are subject to airline changes until paid in full and tickets issued.
  • Times and airlines may change; this does not qualify as a “major change.”
  • Inca Voyage is not liable for delays due to weather, strikes, mechanical issues, or air traffic disruptions.

13. Company Responsibility & Liability

  • We guarantee the accuracy of our final confirmed travel program but not third-party brochures.
  • We act as an agent for transport, lodging, and other services and are not liable for injury, illness, delay, or loss caused by third parties, natural disasters, social unrest, or events beyond our control.

14. Additional Clauses

Force Majeure & Business Insolvency

In the case of permanent closure, operational shutdown, or insolvency, such events will be treated as force majeure. We will make reasonable efforts to refund unused, undelivered services, but full reimbursement is not guaranteed. Our liability will not exceed the total amount paid by the Client.

Insurance Requirement

We strongly advise Clients to purchase comprehensive travel insurance covering trip cancellation, interruption, medical evacuation, and supplier default. Failure to do so is at the Client’s own risk.

Jurisdiction

This Contract is governed by Peruvian law. Any dispute must be resolved in the courts of Lima, Peru, and Clients accept this jurisdiction.
